1. Service Description
ClearSite ("the Service") is operated by KP LTD ("we", "us", "our"). ClearSite provides automated website accessibility scanning, AI-powered analysis, and guidance for identifying and addressing potential accessibility issues.
ClearSite is a diagnostic and guidance tool. It does not provide legal, regulatory, or compliance advice. Use of the Service does not determine whether you satisfy the European Accessibility Act (EAA), Web Content Accessibility Guidelines (WCAG), the Americans with Disabilities Act (ADA), or any other standard or regulation.
2. Scope of Automated Scanning
ClearSite uses axe-core, an industry-standard open-source accessibility testing engine. Automated tests identify a meaningful but incomplete share of accessibility issues. Automated scanning cannot catch every WCAG issue; many issues require human judgment and manual testing to identify.
Scan results are provided "as-is" and represent the state of the scanned URL at the time of scanning. Results may vary between scans due to dynamic content, A/B testing, geolocation, or other factors.
3. AI-Generated Content
ClearSite uses artificial intelligence to generate plain-English explanations and fix instructions. While we strive for accuracy, AI-generated content may occasionally contain errors or inaccuracies. Fix instructions are provided as guidance and should be reviewed before implementation, particularly in production environments.
4. Accounts and Subscriptions
Free scans do not require an account. Paid features require account creation. You are responsible for maintaining the confidentiality of your account credentials.
Paid subscriptions are billed monthly or annually as selected at checkout. You may cancel at any time from your dashboard. Upon cancellation, your subscription remains active until the end of the current billing period.
5. Acceptable Use
You agree not to:
- Use the Service to scan websites you do not own or have authorisation to test
- Attempt to overload, disrupt, or interfere with the Service
- Resell, redistribute, or white-label scan results without a commercial agreement
- Use the Service for any unlawful purpose
6. Limitation of Liability
To the maximum extent permitted by law, KP LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.
We are not liable for any fines, penalties, or legal actions resulting from accessibility issues on your website, whether or not those issues were identified by ClearSite.
7. Data and Privacy
Your use of ClearSite is also governed by our Privacy Policy. Scan results and associated data are processed using the technical and organisational controls described there. We do not share your scan data with third parties except as required to operate the Service, including the processors described in the Privacy Policy.
8. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated via email to registered users. Continued use of the Service after changes constitutes acceptance of the updated terms.
9. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
